Terms of Service

These Terms of Service ("Terms") are an agreement between you and Travel Cheer & Dance Alliance ("we", "us"), which runs the TCDA Courses website (the "Site"). They apply when you create an account, buy a course, take a course or exam, or receive a certificate.

When you create an account or make a purchase, you agree to these Terms, our Privacy Policy and our Purchase & Refund Policy. If you do not agree, please do not use the Site.

1. Who can use the Site

You must be at least 13 years old to create an account, buy a course or use the Site.

If you are 13 to 17, you may use the Site only if your parent or legal guardian agrees to these Terms for you. Your parent or guardian is responsible for your use of the Site and for any purchase made on your account.

The Site is not directed to children under 13. Children under 13 may not create an account, buy a course or use the Site, and we do not knowingly collect personal information from children under 13. If we learn that a child under 13 has created an account, we will close it and delete their personal information.

2. Your account

  • Give us accurate information, and keep it up to date. Use your real first and last name: it is the name that will appear on any certificate you earn.
  • Each account is for one person. Do not share your account or your sign-in details with anyone else.
  • Keep your password private. You are responsible for what happens under your account. Tell us straight away if you think someone else has used it.
  • We may suspend or close an account that breaks these Terms (see section 11).

3. Buying a course

  • Prices on the Site are shown in US dollars. If you are outside the United States, the payment page may show the price in your local currency, and you can choose to pay in US dollars instead. You pay the amount shown on the payment page. If we change a price later, that does not affect a purchase you have already made.
  • You must be signed in to buy, so every purchase belongs to an account. A course you buy can be used by one person: the account holder.
  • Payments are processed by Stripe on Stripe's secure payment page. By paying, you confirm that you are allowed to use the payment method, and you authorize the charge.
  • Sales tax, where it applies, is added at checkout. It is calculated, collected and paid by our payment provider.
  • This is a one-time purchase, not a subscription. You will not be charged again for the same course.
  • You get access to the course as soon as your payment is confirmed. There is nothing to ship.
  • If a price is clearly wrong because of a mistake on our part, we may cancel the order and refund you in full.

4. All sales are final

All sales are final and non-refundable. Before you pay, you must tick a box confirming: "I understand this purchase is non-refundable. All sales are final." We record when you ticked it. The same message appears on your receipt, which you can find under My Learning.

We may, at our sole discretion, issue a refund in a particular case (for example, for a duplicate charge), but we are not required to, and doing so once does not mean we will do so again. Nothing in these Terms takes away any right the law gives you.

Payments are processed by Link, a Stripe service. In limited cases, such as a duplicate or unauthorized charge, Link may issue a refund under its own policy.

If you dispute a charge with your bank or card issuer, we will pause your access to the course while the dispute is open. If the dispute is decided in our favor, your access comes back. If a payment is refunded, or the dispute is decided against us, your access to that course ends, and any certificate earned through that purchase may be revoked.

5. Your right to use the course

When you buy a course, we give you a personal, non-transferable, non-exclusive right to use it for your own learning.

Lifetime access: you can use the edition of the course you bought for as long as your account is open, including any updates we make to that edition. A new edition of a course (for example, for a new season's scoring rules) is a separate course. Your access can still end as these Terms explain: if the payment is refunded or reversed, while a card dispute is open, or if your account is closed or your access is removed under section 11. Any certificate you have earned stays on record.

If we ever stop offering this site, we'll email you at least 30 days before, so you can finish and download your certificate.

You may not:

  • share your account, or let anyone else take the course or the exam for you;
  • copy, record, download, screenshot for others, sell, publish, or share the course content, videos, practice tools, exam questions or answers, except for any materials we clearly offer as a download for your own use;
  • use bots, scrapers or other automated tools to copy the course or the Site;
  • try to get around the paywall, the sign-in, the exam grading or any other protection on the Site.

We may update, correct or improve the course at any time, for example when scoring rules change for a new season.

6. The certification exam and certificates

  • To earn a certificate, you must meet the requirements shown in the course, including passing the certification exam. The passing score is shown in the course. It is currently 90%.
  • The exam is graded on our server. You may retake it. We may limit the number of attempts, and after many attempts we may ask you to contact support.
  • The exam must be your own work. Follow any exam instructions shown in the course. Do not share exam questions or answers.
  • Check your name before you take the exam. You can correct your name in Account settings; your certificate uses the name on your account.
  • What a certificate means: it confirms that the person named completed the course and passed its exam on the date shown. It is issued by Travel Cheer & Dance Alliance (TCDA). Unless the certificate itself says otherwise, it is not a government license. It is not an accreditation from any other organization. It does not guarantee that any event producer will hire you or assign you to judge. Event producers decide who judges their events and which rules apply.
  • Certificates do not expire. Each certificate reflects the scoring rules in force when you passed. When rules change, we may offer updated training, and event producers may ask for a current certificate.
  • We may revoke a certificate if it was earned dishonestly (for example, someone else took the exam, or the account or exam answers were shared), if the payment for the course is refunded or reversed through a card dispute, or if we issued it by mistake.

7. Our content and trademarks

The Site and everything in it belongs to us or to the people who license it to us. That includes the courses, lessons, videos, text, scoresheets, rubrics, practice tools, exam questions, certificates, designs and software. The TCDA and Travel Cheer & Dance Alliance names and logos, the Precision Live Scoring and PLS names and logos, and other marks on the Site are trademarks of us or of our licensors. You may not use them without written permission. Except for the right to use the course in section 5, these Terms do not give you any rights to our content.

If you send us suggestions or feedback, we may use them without owing you anything.

8. Using the Site fairly

Do not:

  • break the law while using the Site;
  • attack, overload or disrupt the Site, or try to reach parts of it or data you are not allowed to see;
  • pretend to be someone else, or create accounts with false details;
  • harass or abuse our staff.

9. Other companies' services and links

Payments are handled by Stripe under Stripe's own terms. The Site links to other websites, such as travelcheer.com, Google Drive documents, YouTube and plscalculator.com. We are not responsible for other websites, and their own terms and privacy policies apply to them.

10. Disclaimers

The courses are educational training. We work hard to keep them accurate, but scoring rules, rubrics and event policies can change. The rules and decisions of each event producer are what count at that event. We provide the Site and the courses "as is" and "as available". To the extent the law allows, we make no other promises about them, including that the Site will always be available or free of errors.

11. Suspension and closing an account

You can stop using the Site at any time. You can also ask us to delete your account, as our Privacy Policy explains. Deleting your account ends your access to your courses and does not come with a refund.

We may suspend or close your account, remove access to a course, or revoke a certificate if you break these Terms, if we need to protect the Site or other people, or if the law requires it. Where it is reasonable, we will tell you why.

12. Limit on our liability

To the fullest extent the law allows:

  • we are not liable for indirect or consequential losses, such as lost income, lost judging opportunities or lost data;
  • our total liability to you for any claim about the Site or a course is limited to the amount you paid us for the course the claim is about.

Nothing in these Terms limits any liability that the law does not allow us to limit.

13. Your responsibility to us

If you break these Terms or the law, and someone makes a claim against us because of it, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.

14. Resolving problems and which law applies

If you have a problem, please contact us first at support@travelcheer.com. Most problems can be fixed quickly. If we cannot settle it informally within 30 days, either of us may take it to court.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any court case will be heard in the state or federal courts located in Stanislaus County, California, except that either of us may bring a claim in small claims court if it qualifies.

15. Changes to these Terms

We may update these Terms. When we do, we will post the new version here with a new effective date. If a change is significant, we will tell you by email or with a notice on the Site before it takes effect. The version in force when you made a purchase continues to apply to that purchase.

16. General

  • These Terms, the Privacy Policy and the Purchase & Refund Policy are the whole agreement between you and us about the Site.
  • If any part of these Terms cannot be enforced, the rest still applies.
  • If we do not enforce a right straight away, we can still enforce it later.
  • You may not transfer your account or these Terms to anyone else. We may transfer them if our business, or the Site, moves to another company.
  • We may send you notices by email, to the address on your account, or on the Site.

17. The National PLS Judge Directory and TCDA-verified event producers

When you create an account or buy a course, we ask whether you are taking it as a judge, a coach or something else, and where you are: your ZIP code, or your country if you live outside the US.

  • Judges may choose to join the National PLS Judge Directory. Joining is optional, and not joining changes nothing about your course. If you join, TCDA, Precision Live Scoring and TCDA-verified event producers may contact you about judging opportunities. You can leave the directory at any time in Account settings. Joining is not a promise that anyone will offer you work.
  • Coaches, and everyone else who is not taking the course as a judge, must agree before buying or continuing a course that their name, contact details and location may be shared with TCDA-verified event producers.
  • A TCDA-verified event producer is a company that runs cheer or dance events and that TCDA has checked and approved. Each event producer is responsible for how it contacts you and how it uses your details, under its own terms and privacy policy.
